Intellectual Property Statement
At Imaginings by Kat, every design is created with care, creativity, and attention to detail. Whether I'm designing custom challenge coins, artwork, commemorative displays, branding, or other creative products, the intellectual property rights associated with my original work are important.
Unless otherwise agreed in writing, all concepts, artwork, illustrations, designs, digital files, and other creative material created by Imaginings by Kat remain the intellectual property and copyright of Imaginings by Kat.
Once full payment has been received, clients are granted a perpetual licence to use the final approved design for the purpose for which it was commissioned. This allows the design to be manufactured, displayed, or used by the client as agreed during the project.
This licence does not permit the artwork or design to be:
-
sold or licensed to another party;
-
altered or reproduced for purposes outside the original project;
-
supplied to another designer or manufacturer for reuse without prior written permission from Imaginings by Kat.
Editable source files, production artwork, working files, and design assets remain the property of Imaginings by Kat unless specifically included as part of the project or transferred under a separate written agreement.
To showcase the work completed, Imaginings by Kat reserves the right to display completed projects in portfolios, on this website, and across social media and other marketing material, unless a confidentiality agreement has been made with the client.
Where a client requires exclusive ownership or assignment of copyright, this can be arranged by written agreement before work commences and may incur an additional fee.
Challenge Coin Design & Manufacturing
Custom challenge coin artwork created by Imaginings by Kat is developed specifically for manufacture through Imaginings by Kat and its approved manufacturing partners.
Unless otherwise agreed in writing, the client does not have permission to provide, reproduce, or distribute the artwork, production files, or design concepts to any third-party manufacturer, supplier, or designer for the purpose of manufacturing, reproducing, or modifying the design.
Where a client wishes to manufacture a design through another supplier, written permission must first be obtained from Imaginings by Kat. Approval may be subject to the purchase of an Intellectual Property Assignment or an agreed licensing fee.
Unauthorised reproduction or manufacture of artwork created by Imaginings by Kat may constitute an infringement of copyright and other intellectual property rights under Australian law.
Government and Defence Projects
Where work is completed under a Commonwealth, Defence, or other government contract that specifies ownership of intellectual property, the terms of that contract will take precedence over this policy.
